An easy market for prefabrication, and a strict one
Germany is unusual in Europe in that the factory-built house needs no defending. The Fertighaus has a long, mainstream and respectable history here; banks lend on it, appraisers value it and buyers at the top of the market do not treat it as a compromise. For a client used to explaining the concept elsewhere, that is a considerable relief.
What Germany does not do is relax the technical standard. Structural verification is independently checked, site supervision is a named legal responsibility, acoustic requirements are among the strictest in Europe, and the energy law is enforced through documented calculation rather than good intentions. The useful observation is that these two facts point the same way: the easiest place to meet a demanding standard consistently is a controlled factory, where the work is measured, sequenced and inspected indoors rather than negotiated in the weather.
The Bauantrag: sixteen states, sixteen building codes
German building law lives at two levels, and knowing which one governs which question saves a great deal of confusion.
Planning law is federal, in the Baugesetzbuch. It decides whether and what you may build on a given plot, and there are three situations:
- A plot inside a binding development plan — a Bebauungsplan under §30 BauGB. The plan states the permitted use, footprint, number of storeys, roof form and building lines. This is the most predictable case: you can read the answer before you buy.
- A plot inside an existing built-up area with no development plan — §34 BauGB. The test is whether the proposal fits the character of its surroundings. Predictable in outline, arguable at the margins, and very much a matter for judgement — which is where an advance ruling earns its fee.
- A plot in the open countryside — the Außenbereich, §35 BauGB. New housing here is essentially not permitted, the exceptions being narrow and mostly agricultural. Buying an inexpensive countryside plot expecting a villa is the classic, expensive German mistake. Verify the classification before you sign.
Building law, by contrast, is state law: each of the sixteen federal states has its own Landesbauordnung, with its own procedure, its own submission requirements and its own thresholds. A project in Bavaria and the same project in Lower Saxony are not filed the same way.
Two procedural tools are worth knowing about. The first is the Bauvorbescheid, a binding preliminary ruling on specific questions put to the authority — typically "may a dwelling of roughly this size and form be built here at all?". It is the single most effective way to de-risk a plot purchase or a design commitment in Germany, and for a §34 plot it is often the difference between a calculated decision and a gamble. The second is that several states allow a notification procedure with no full permit where the plot lies inside a development plan and the proposal complies with it, which can save months. Which applies to you depends on the state and the plot.
The submission itself must be made by a person entered on the relevant state roll as authorised to file building applications, the structural verification is independently checked by an approved engineer, and construction is overseen by a named site manager. The DIN standards that actually shape the house
Structural design follows the Eurocodes with the German National Annex, and the Annex is not a formality — its snow and wind zone maps produce materially different structures across the country. The North Sea and Baltic coasts sit in the highest wind zone; the alpine foothills carry high snow loads; the east has a more continental swing than most clients expect. A design is recalculated for the actual location as a matter of course.
Beyond the structure, three areas of the German standards do more than anywhere else in Europe to determine how the house is built:
- Thermal and moisture protection, DIN 4108. Minimum thermal quality, thermal bridge treatment and moisture safety in the build-up. Also the summer heat protection verification under DIN 4108-2 — a required calculation, not an optional comfort study, and a real constraint on a house with generous glazing.
- Airtightness. A blower-door test on the finished dwelling is the normal means of verification, and the value achieved feeds directly into the energy calculation. Factory-sealed envelopes test well, consistently, which is what makes the higher efficiency levels reachable without heroics.
- Sound insulation, DIN 4109. German acoustic requirements are stricter than most European equivalents, and at the luxury end clients almost always want to sit well above the legal minimum — quiet bedrooms, no impact noise through a staircase, plant that cannot be heard. Acoustic performance is a product of decoupled layers and consistently executed junctions, which is factory work rather than site work. It is one of the clearest places where off-site manufacture shows up as something you can hear.
GEG: energy, heating and the funding question
The Gebäudeenergiegesetz sets the requirements for a new dwelling: a primary energy target, minimum envelope quality, and a required share of renewable energy in the heat supply. Recent amendments to the heating rules push new-build housing firmly towards heat pumps, and for a well-insulated, airtight house that is the sensible answer anyway — a low-temperature system, mechanical ventilation with heat recovery, and shading designed rather than retrofitted.
Above the legal minimum sit the federal efficiency levels and the associated KfW funding for houses that beat the standard by a defined margin. These programmes are genuinely valuable and genuinely volatile: terms change, budgets run out and schemes have been paused at short notice more than once. We will tell you what is available at the time you apply and design to qualify where it makes sense, but we will not promise you a subsidy that may not exist by the time the application lands. Anyone who does is selling you a number they do not control.
Transport: Großraum- und Schwertransport
Germany is an all-road destination from our factory — Spain, France, Germany, no customs, no sea leg — which makes it one of the more straightforward European deliveries. The variable is the load itself.
- Module width is a design decision made during engineering. Up to roughly 2.55 m wide, a module travels as ordinary freight. Beyond that — or beyond about 4 m high or 40 t — it becomes an oversized or heavy transport requiring an exemption under the road traffic regulations, applied for through the national VEMAGS system, with an approved itinerary and escort vehicles. Wider modules give fewer joints and better interiors, so the trade-off is real and it belongs in the design phase, not the shipping phase.
- Route approval is about structures, not kilometres. Bridge capacities, tunnel and underpass clearances, roundabout geometry and the movement windows the authority permits — often at night — govern the plan.
- The last few hundred metres decide the crane. Residential access roads, tram and trolley wires, mature street trees, parked cars and the ground the crane has to stand on routinely cost more thought than the entire motorway leg.
All of it is assessed at feasibility stage, because access constraints can reshape the module layout — and it is far cheaper to discover that on a drawing than on a Tuesday morning outside your plot.
VAT, who invoices and the taxes on the land
Building a house is work on immovable property and is taxed where the land is, so German VAT at the standard rate applies to a new dwelling built in Germany, whoever manufactures it and wherever the factory sits. There is no reduced rate for new residential construction in Germany.
One point deserves specific attention with a foreign contractor: German reverse-charge rules for construction services can shift the VAT liability from the supplier to the recipient depending on the recipient's status. That genuinely changes who accounts for the tax and how, and it is not something to work out after the first invoice. Separately, the land purchase carries real estate transfer tax at a rate set by each state, plus notary and land registry fees, and the finished house carries annual property tax.

Do I need a building permit for a modular home in Germany?

Is a factory-built house accepted by German banks and appraisers?
